How to Cancel Your Washington Lien

  1. Confirm payment or resolution. Make sure the amount secured by the recorded lien has been paid or otherwise settled.

  2. Prepare the Release of Lien. Include the original lien’s recording number, recording date, property information, and claimant details.

  3. Sign before a notary. The claimant should sign the release with the proper notarization for county recording.

  4. Record the release. File it with the county auditor in the same county where the original Claim of Lien was recorded.

  5. Keep proof of recording. Request a conformed or recorded copy for your files and provide one to the property owner if appropriate.

FAQs

Frequently Asked Questions

What is a Washington State lien release?

A lien release in Washington removes a previously recorded mechanics lien from a property’s title. It shows the debt has been paid or resolved.

When do I need to file a lien release in Washington?

Under RCW 60.04.071, the lien claimant must release the lien after payment is accepted and the owner or payer demands it. Delay can lead to costs, attorney fees, and damages.

Does this template need to be notarized?

Yes. The signature must be notarized before the county auditor will record it.

Where do I file my lien release form?

Record it with the county auditor where the original Claim of Lien was filed, and include the original recording number. If you’d prefer to have a professional handle the filing, order your lien release through Northwest Lien. We’ve helped thousands of contractors since 1999.

Is this a conditional or unconditional lien waiver?

No. It is a formal Release of Lien that cancels an already recorded lien. Waivers are usually exchanged for payments before a lien is filed.

What is the difference between a lien waiver and a lien release?

A lien waiver is an exchange of rights executed before filing a lien, serving as a receipt showing payment was received and waiving future lien rights. A lien release is an official document recorded in county land records that removes a claim already filed.
