What Is A Nevada Mechanics Lien?

A Nevada mechanics lien, or materialman’s lien, is a legal claim against a property for unpaid labor or materials on a construction project. Governed by NRS Chapter 108, it attaches to the property and can complicate a sale or refinancing until it’s settled. Any party providing labor, materials, or equipment, such as contractors or suppliers, may file a lien, each with specific notice and deadline requirements.

How To File A Mechanics Lien In Nevada

Follow Nevada’s strict statutory lien process under NRS Chapter 108, so your payment rights remain protected.

1

Serve Notice of Right to Lien

Subs, suppliers, and equipment providers must serve the owner with a Notice of Right to Lien and send a copy to the prime contractor within 31 days of providing labor or materials. GCs must deliver statutory disclosure.

2

Prepare Mechanics Lien Form

A valid claim must state the amount owed after credits, describe the labor or materials, identify the property by legal description and APN, name the owner and hiring party, and include a notarized oath.

3

Record the Lien

Record the notarized lien document with the county recorder where the property is located within 90 days of your last furnishing or project completion, or 40 days if a Notice of Completion was recorded.

4

Serve the Owner

Within 30 days after recording the lien, deliver a stamped copy by certified mail or personal delivery to the property owner. Subcontractors and suppliers must also deliver a copy to the prime contractor.

5

Enforce or Foreclose

A Nevada mechanics lien expires 6 months after it’s recorded. To keep the claim active, you must file a formal foreclosure lawsuit in court before that deadline.

6

Release the Lien

Once you receive payment, release the mechanics lien. State law requires you to file a cancellation document, and delays can lead to substantial financial penalties.
